Voucher Terms
TERMS AND CONDITIONS APPLICABLE TO VOUCHERS RECEIVED IN A PROMOTION OR COMPETITION RUN BY OR IN CONJUNCTION WITH DUSK + VINE PHOTOGRAPHY
- Vouchers are non-transferable.
- Vouchers are not redeemable for cash.
- A voucher may be used towards a Dusk + Vine Photography Portrait Photography Experience of your choice.
- Only one voucher may be used per Portrait Photography Experience.
- Only one voucher can be won or used per family in a 12 month period.
- Voucher must be presented to Dusk + Vine Photography at your session.
- A Portrait Photography Experience fee (session fee) of $100 will be deducted from the voucher and includes Shoot Design Appointment, Photography and Ordering Session. Any remaining credit can be used towards prints or products of your choice.
- Voucher credit cannot be used as the required deposit on an order; it does however come off your total order.
- Please refer to your voucher for expiry date [if applicable]. An expiry date may not be extended.
- Additional Shoot Design Appointments or Ordering Sessions are available and will be charged at $100 each, payable at the time of consultation. Voucher credit cannot be used against these appointments.
- If you miss a scheduled consultation, you are required to contact us within 72 hours to re-book. The new appointment must be held within seven days of the original appointment time, otherwise your voucher will be forfeited.
- If you fail to attend a booked shoot and do not make contact with us prior to the scheduled shoot time, you will forfeit the value of your voucher in its entirety.
Standard Terms & Conditions
TERMS AND CONDITIONS APPLICABLE TO VOUCHERS RECEIVED IN A PROMOTION OR COMPETITION RUN BY OR IN CONJUNCTION WITH DUSK + VINE PHOTOGRAPHY
- Session Fee: Your session fee is $100.00. A session fee required upon booking and is non-refundable. This fee secures your session booking and the current pricing structure – a pre-session consultation, $50 credit towards print art, personal password-protected gallery for viewing, a viewing and ordering appointment
- Your session fee does NOT include any digital files, print art or art collection
- Dusk + Vine Photography has a minimum spend of $500.
- Cancellation:In the event of an illness or misadventure, please call as soon as possible to reschedule. Dusk + Vine Photography by Ashlee maintains the right to reschedule at any time should it become necessary but will do our upmost to negotiate a mutual acceptable re-booking. The request must be made no later than 24 hours prior to your scheduled booking.
- Electronic Devices: Cameras, phone cameras, and video are not permitted during any session unless approved by Dusk + Vine Photography.
- Raw images:Dusk + Vine Photography does not deliver images that have not been edited to the highest professional standard and to the style of her portfolio. You will receive your images as original resolution after editing. Raw images are kept for 3 months after your session and your edited images are kept for 12 months. Dusk + Vine will not be liable if an technical issues occur after you have received your digital files. Please back them up to a secondary source.
- Payment:Dusk + Vine Photography will not start any gallery retouching/editing on finalised images until session fee payments have been finalised. Full payment of your chosen package must be paid within 14 days of when your online gallery was issued. You can set up a payment plan with Payright (fees occur) if you wish to pay off over a few months to a year.
- Digital images:Once your gallery has been issued, Collection of images must be finalised within 14 days. Dusk + Vine Photography will provide you with assistance if required in choosing your collection. Please read below liability in regards to printing. Dusk + Vine will keep your edited digital files for six months.
- Art Collections: Once Art Collections and print art have been ordered by Dusk and Vine you cannot cancel your order or request a refund.
- Model Release/Copyright: Dusk + Vine Photography retains the copyright on all images and reserves the right to use the images for advertising, display, publication, social media and/or other purposes for our portfolio. The client signing their contract warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the photographer in the event of litigation arising out of such use. Digital files and previews remain the exclusive property of Dusk + Vine Photography. Under no circumstances, can a client use these images for profit, commercial endeavours, professional display, or in competition. Copying, snap shotting, saving or scanning images from the clients gallery, Dusk + Vine Photography website, or social media sites is considered stealing, regardless of the intent for use. If client steals images via any method listed above, or any other method, client will be invoiced for the cost of EACH digital image client has stolen, at photographer’s current price per digital file. SHARING images and links on the web from its main source is highly acceptable and encouraged to show family and friends your beautiful images.
- Liability: The client is aware if they choose to print their images through a personally chosen lab that the quality of the end result print of the digital files delivered is not under the control of the photographer, and frees Dusk + Vine Photography from any liability for any potential claims whatsoever based upon discolouration in the end result. If Dusk + Vine Photography cannot fulfil this contract due to fire or other causality, or beyond the control of the photographer, or due to the photographer’s illness or emergency, then the photographer shall return any deposit or session fee to the client but shall have no further liability with respect to the contract. This limitation on liability shall also apply if the event of photographic materials is damaged without fault on the photographer. The client releases any and all employees of Dusk + Vine Photography from all liabilities, claims and damages that may result from any accidents or incidents that could have been prevented that may happen during the session. Dusk + Vine Photography is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business. By signing this contract, you are agreeing not to copy, save, or reproduce images in anyway other than backing up your digital files. This includes copying and saving images from website, social media, or any there form of advertisement.
- All participants must sign a model release form before your shoot begins, this will be emailed with a booking confirmation for electronic signature.
- Dusk + Vine retain the right to enter any images in industry awards and competitions.
- Photo sessions are only available to immediate family; if other family members are to be involved please consult Ashlee prior to your session.
Covid 19 Policy
Studio policies
– All props, blankets, clothing, etc. will be sanitised with disinfectant before and after every session. These measures were already in place, but more detailed attention will be given to sanitising the entire studio between sessions
– No outside props will be able to be used, only those of unless discussed and approved
– You will be asked to immediately sanitise your hands and sanitiser is readily available
– I will be wearing a face mask for the duration of the session
– All seating areas will be sanitised after every session
– Only immediate family members will be allowed to attend sessions until further notice
Your Part
– Limit visitor interaction until after your scheduled appointment takes place (this is especially important for newborn sessions.)
– Cancel/reschedule your appointment for a later date if you have any of these symptoms: cough, fever, dizziness, loss of taste or smell, fatigue not caused by lack of sleep or breathing difficulty
– If you or someone in your home is sick, you must reschedule. If you arrive sick, the session will be cancelled and rescheduled
TERMS
Term 1 *I knowingly and willingly consent to a photography session with , photographer and owner of Ashlee Cobcroft
Term 2 *I understand that the COVID-19 virus has a long incubation period during which carriers of the virus may not show any signs or symptoms and still be contagious. I understand that will take all precautions suggested regarding COVID-19 prevention, but it is impossible to determine who has it and who does not given the current limitations in virus testing.
Term 3 *I understand that should I have been diagnosed with COVID-19, positive within 14 days before/following my session, I will contact to let her know of my positive diagnosis.
Term 4 *I release for any and all liability associated with receiving a COVID-19 positive diagnosis following our session.
Term 5 *I confirm that no member of my family that will be included in the session, coming to the studio, or that I have had recent exposure to is experiencing any of the following symptoms associated with COVID-19: fever, shortness of breath, dry cough, runny nose, sore throat, loss of taste or smell, fatigue not associated with sleep. If they experiencing any of the above mentioned symptoms, I will call immediately to reschedule my session.
Term 6 *I understand that has the right to cancel or reschedule any session at any point in time due to COVID-19 implemented regulations, health concerns, possible exposure, or arising symptoms of COVID-19, and is not liable for any costs accrued by the client (i.e. hair appointments, cake or clothing purchases, etc) associated with my session.
Term 8 *If my session is cancelled or rescheduled due to a COVID-19 related illness or presenting symptoms, I understand that the session fee paid to is non-refundable but will be transferred to a new date.
